Civil Changes

Civil Changes Effective January 1, 2001
The following is a list of changes affecting civil cases in the Superior Court of California, County of Sacramento, effective January 1, 2001. Included is a brief description of each item plus legal authorities and primary effects customers will encounter as a result of changes. Copies of local rules and forms may be purchased in room 102 of the downtown courthouse at 720 Ninth Street or obtained from the court website.

Increase of Filing Fees
Effective January 1, 2001, some civil filing fees will be increased pursuant to Business and Professions Code section 6322.1.

Any filing received after January 1, 2001, without proper fees will be returned without being filed. See overview of changes below.

Affidavit of Identity for Issuance of Abstract or Writ
Code of Civil Procedure sections 674, 699.510, 699.520, 699.540, 699.545, 700.010, and 700.160 were amended, and 680.135 was added requiring an affidavit of identity for issuance of an abstract of judgment or writ of execution when a judgment debtor is known by additional names after judgment. The affidavit of identity shall set forth the case name and number, the name of the judgment debtor stated in the judgment, the additional names or names by which the judgment debtor is known, and the facts upon which the judgment creditor has relied in obtaining the judgment debtor's additional name or names, and shall be signed under penalty of perjury.

Notice of Waiver of Jury Trial
Pursuant to California Rules of Court section 222.1, as adopted, in limited civil cases, if a jury is demanded by either party and that party subsequently waives trial by jury, all adverse parties have five days following receipt of the notice of waiver to file and serve a demand for trial by jury and deposit any advance jury fees.

Repeal of Municipal Court Rules in Light of Trial Court Unification
Due to trial court unification, California Rules of Court rules for municipal courts in the 500 series are repealed, former superior court rules in the 200 series apply to all types of cases.

Mandatory Guardian ad Litem Form for Civil Cases
The Judicial Council has adopted a form for mandatory use for an application and order for appointment of guardian ad litem in civil cases.

Motion to Tax Costs
Pursuant to Local Rule section 9.16.5, as amended, all motions to tax costs presented for filing must have an endorsed copy of the memorandum of costs attached.

Filing Records Under Seal
California Rules of Court, rules 12.5, 243.1, 243.2, 243.3, 855, and 859 provide appellate and trial court standards and procedures for filing records under seal.
