  • Bankruptcy

    1. Are you married? If no, you qualify.

    The Sacramento County Bar Association and the Lawyer Referral and Information Service (LRIS) offers flat fee services for certain legal matters. The flat fee to file a chapter 7 bankruptcy is $850. An attorney will work with the member to prepare and complete the necessary paperwork. This fee does not include government filing fees or costs for required credit counseling and debtor education courses. To qualify for this flat fee service, the debtor must be single and not own any real estate.

     

    Included Services

    Advising debtor before filing bankruptcy; communications with creditors; filing all necessary documents to commence the bankruptcy proceeding including petition, required schedules, and statement of financial affairs; preparation and filing reaffirmation agreements; communications with assigned trustee; and, appearing with debtor at the meeting of creditors.

     

    Excluded Services

    Services do not include addressing objections to bankruptcy discharge or representation for any adversary proceeding, required government filing fees, required costs for credit counseling and debtor education courses, any guarantee regarding the outcome or success of the bankruptcy filing, or any other legal work.

     

  • Estate Plan for Married Couple or
    Registered Domestic Partners

     

    1. Are you married or in a Registered Domestic Partnership? If yes, you qualify.
    2. Are you interested in retaining an attorney to draft a complete estate plan for both of you, jointly? If yes, you qualify. If you do not know what is included in that, you will need to talk to the attorney about the details, but the MAIN documents are: Revocable Living Trust, 2 Pour Over Wills, 2 Durable Powers of Attorney for Finances, 2 Advance Health Care Directives, and a Trust Transfer Deed.
    3. Do you own any real estate? If one (1) or less, you qualify. Only 1 will qualify for the flat fee, but additional deeds may be provided by the attorney for an extra fee.
    4. Do you have any children with special needs (i.e. receiving public benefits)? If not, you qualify.

The flat fee to draft a complete estate plan for a married couple or registered domestic partners is $1500. An attorney will work with the member to prepare and complete the necessary paperwork. This fee does not include County Recorder fees to record real property deeds.

     

    Included Services

    Services include drafting a single person Revocable Living Trust, 2 Pour Over Wills, 2 Durable Powers of Attorney for Finances, 2 Advance Health Care Directives, and a Trust Transfer Deed, plus all necessary supporting documents.

  • Estate Plan for Single Person

    1. Are you married or in a Registered Domestic Partnership? If no, you qualify. If yes, see below.
    2. Are you interested in retaining an attorney to draft a complete estate plan for you?   • Naturalization

    1. Have you been a lawful permanent resident for 3 years (married to and living with a US citizen) or 5 years? If yes, you qualify.
    2. Are you at least 18 years old? If yes, you qualify.
    3. Do you have good moral character? This typically means community volunteering, stable work history, and no criminal record. If yes, you qualify.
    4. Can you show continuous residence and physical presence for the 3 or 5 year period leading up to application - continuous residence is question of fact, but no stays longer than 180 consecutive days or 1 year in total; physical presence means applicant was here in the US 18 months for a 3 year applicant and 30 months for a 5 year applicant and at least 3 months of residence in the jurisdiction they are applying. If yes, you qualify.
    5. You can pass the citizenship examination - English and Civics examination, with exception for elderly and mentally ill. If yes,  you qualify.
    6. Have you committed any crimes? If no, you qualify. If yes, talk to an attorney first, refer to Part 12 of N-400 (current form, page 11-16).

    The Sacramento County Bar Association's Lawyer Referral and Information Service (LRIS) offers a flat fee service for naturalizations. The flat fee for cases not involving crimes and any issues related to the questions listed under Part 12 of the N-400 is $850, not including the filing fee that is currently $680 for most, with some exceptions, and an attorney's appearance at the naturalization interview. An attorney will work with the client to prepare and complete the necessary paperwork for filing.

     

    Included Services

    Filing of N-400 and supplemental documents necessary for filing.

     

    Excluded Services

    Attorney's appearance at interview, filing fee, request for evidence, response for denial, motion to reopen/ reconsider, and any other services after a response is made by users after a naturalization interview is held.

  • Single Member LLC

    1. How many members will operate the LLC? If one (1), you qualify.
    2. Will the LLC provide professional services that require a license? If not, you qualify.

    The Sacramento County Bar Association and the Lawyer Referral and Information Service (LRIS) offers flat fee services for certain limited legal matters. The flat fee to form a single member limited liability company (LLC) is $850. An attorney will work with the member to prepare and complete the necessary paperwork. This fee does not include government filing fees. To qualify for this flat fee service, there may only be one LLC member.

     

    Included Services

    Services include name inquiry with the Secretary of State, drafting and filing the articles of organization, drafting the operating agreement, and filing the SS-4 form to obtain the federal employer identification number.

     

    Excluded Services

    Services do not include government filing fees, any guarantee regarding the outcome or success of the LLC formation, or any other legal work.
